Terms & Conditions
1. Purpose
These Terms of Service (the "Terms") set out the conditions under which Monitorank SAS (hereinafter the "Provider") grants its clients (hereinafter the "Client") access to its service for collecting and providing Google search results (hereinafter the "SERPs").
2. Services Provided
The Provider offers the Client an online service to obtain data from Google search results pages, accessible via a web interface and/or an API.
The data is provided in structured form (JSON) or raw form (HTML), depending on the volumes and terms agreed upon at the time of the order.
3. Orders and Access to the Service
- Access to the service requires the creation of a Client account.
- The Client credits their balance in order to consume the service. Each request to retrieve a SERP is deducted from this balance.
- Prices are on a sliding scale depending on the credited amount, as displayed on the Provider’s website.
- Payment is made by credit card. The Client may activate an automatic top-up to ensure uninterrupted service.
4. Pricing and Billing
Prices are quoted in euros, excluding taxes (VAT).
The Provider reserves the right to modify its prices at any time but agrees to apply the rates in effect at the time of the order.
An invoice is generated and made available to the Client for each balance credit.
5. Intellectual Property and Data Usage
- The data provided (SERPs) remains the exclusive property of the Provider.
- The Client is granted a personal, non-exclusive, and non-transferable right to use the data for their own professional purposes.
Prohibitions:
- It is strictly forbidden to share, resell, redistribute, or make available to third parties the data obtained through the service (files, exports, API) without transformation or added value.
- It is also forbidden to supply, even in an enriched or transformed form, all or part of the data to a third party whose main activity is the commercialization or redistribution of SERP data (e.g., direct competitors such as SEO platforms or position database providers).
- Any attempt to provide direct access to the Provider’s API or to exploit the data in a competing service is prohibited.
Authorizations:
- The Client is authorized to integrate and use the data within their own tools, dashboards, reports, software, or services, including in commercial solutions provided to their end customers.
- Such integration is permitted as long as the data is used as a component of a broader service (e.g., SEO tools, reporting platforms, consulting services) and is not redistributed to other companies for independent commercial exploitation.
6. Consequences of Non-Compliance
In the event of non-compliance with these Terms of Service, particularly regarding the use and distribution of the provided data, the Provider reserves the right to take any appropriate action, including but not limited to:
- immediate suspension of the Client’s account, without notice and without refund of any amounts paid;
- permanent deletion of the account in case of serious or repeated breaches;
- preservation of the right to seek damages to compensate for any harm suffered due to the breach of these Terms;
- initiation of legal proceedings, if necessary.
These measures may be applied cumulatively, depending on the severity of the breach.
7. Client Obligations
The Client agrees to use:
- the service in compliance with applicable laws;
- not attempt to bypass the service’s security systems;
- and not use the provided data in any illegal or unethical context.
8. Provider’s Liability
The Provider shall make all reasonable efforts to ensure the availability and reliability of the service. However, the Provider cannot be held liable in cases of:
- internet network outages or technical failures
- changes to Google’s operations affecting the collection of SERPs
- or misuse or abusive use of the service by the Client.
9. Term and Termination
The agreement is concluded for an indefinite period as from the Client’s acceptance of these Terms of Service.
The Provider reserves the right to terminate the Client’s account in the event of a serious breach of these Terms, particularly in cases of prohibited sharing or resale of the data.
10. Personal Data
The Provider processes the Client’s personal data in accordance with applicable regulations (GDPR). The information collected is used solely for account management and billing purposes.
11. Governing Law and Jurisdiction
These Terms of Service are governed by French law.
Any dispute relating to the performance or interpretation of these Terms shall fall under the exclusive jurisdiction of the competent courts in the district of the Provider’s registered office.
